Enkindle Counseling LLC ("Enkindle Counseling," "we," "our," or "us") respects your privacy and is committed to being transparent about the limited information we collect through our website at https://www.enkindlecounseling.com (the "Site"). This Privacy Policy explains what information we collect, how we use it, how we protect it, and the rights you have regarding your personal information.

This Privacy Policy applies only to information collected through the Site. It does not apply to information shared with us during a clinical session or as part of your therapeutic care, which is governed separately by federal HIPAA regulations and our Notice of Privacy Practices, which is provided to clients at intake.

We collect personal information you provide voluntarily when you:

Important: Please do not include sensitive health information (Protected Health Information, or PHI) in messages submitted through our Site or via standard email. The Site contact form and standard email are not encrypted for the transmission of PHI.

Information Collected Automatically

When you visit our Site, certain information is automatically collected:

  • Analytics data: We use Google Analytics 4 to understand how visitors use our Site, including pages visited, approximate time spent on pages, general geographic region (city or state level only), device type, and referral source. This data is aggregated and is not used to identify you individually.

  • Cookies and similar technologies: We use cookies as described in Section 6 below.

We use the information we collect to:

  • Legal requirements: We may disclose information if required by law, court order, subpoena, or to protect rights, property, or the safety of our practice, our clients, or the public.

  • Business transfers: If we transfer or sell our practice, your information may be transferred as part of that transaction, subject to this Privacy Policy.

For Colorado Residents

Although our practice may not meet the Colorado Privacy Act (CPA) thresholds for mandatory compliance, we voluntarily extend the following CPA-aligned rights to all Colorado residents who interact with our Site:

  • Right to access: Request confirmation of whether we process your personal data and access to that data.

  • Right to correct: Request correction of inaccurate personal data.

  • Right to delete: Request deletion of personal data we have collected from you.

  • Right to data portability: Request a copy of your personal data in a portable, commonly-used format.

  • Right to opt out: Opt out of the processing of your personal data for purposes of (1) targeted advertising, (2) the sale of personal data, or (3) certain types of profiling. Note: We do not engage in any of these activities, but we recognize this right.

Universal Opt-Out Mechanisms

We honor browser-level Global Privacy Control (GPC) signals as opt-out requests for the sale of personal data and targeted advertising. As noted above, we do not engage in either activity, but we recognize the GPC signal as a valid privacy preference and confirm our compliance.

We use reasonable administrative, technical, and physical security measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of internet transmission or electronic storage is completely secure. We strongly encourage you to use our secure SimplePractice client portal for any communications involving sensitive or health-related information, rather than email or web forms.

9. Data Retention

We retain personal information collected through the Site only as long as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Contact form submissions are typically retained for 12 months unless they result in an established therapeutic relationship, in which case clinical records are retained according to Colorado licensing board requirements and HIPAA, separately from this Site's records.

10. Children's Privacy

Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information through our Site, we will delete it promptly. Parents or guardians who believe a child has provided information to us may contact us at info@enkindlecounseling.com to request deletion.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. The "Last Updated" date at the top of this policy will reflect any revisions.
